These Terms and Conditions (“Terms”) govern access to and use of the website, mobile application, online and offline classes, courses, educational content and other services offered by Swaraj Coaching Institute, Indore, a proprietorship concern owned by Dr. Pradeep Patidar (“Swaraj Coaching Institute”, “Institute”, “we”, “us” or “our”).

 

By visiting our website, submitting a registration or admission form, making a payment, creating an account, accessing a course, attending a class or otherwise using our services, you confirm that you have read, understood and agreed to these Terms.

 

Where a Student is below 18 years of age, these Terms must be accepted by the Student’s parent or lawful guardian.

2. Definitions

For these Terms:

 

  • “Student” means a person registered for or enrolled in a Course.
  • “Parent/Guardian” means the lawful parent or guardian of a minor Student.
  • “Course” includes any online or offline batch, recorded course, live programme, test series, study programme or other educational service.
  • “Course Details” means the course description, duration, language, fee, access period, syllabus and other information displayed before purchase.
  • “Platform” means our website, Classplus-powered mobile application and any authorised digital system used to provide services.
  • “Content” includes lectures, recordings, PDFs, eBooks, notes, tests, questions, solutions, graphics, presentations and other educational materials.
  • “User” includes a Student, Parent/Guardian, website visitor or other person using our services.

3. Scope and Order of Applicable Terms

Use of our services is governed collectively by:

 

  1. These Terms and Conditions;
  2. The applicable Course Details displayed at purchase;
  3. Our Privacy Policy;
  4. Any separately displayed Refund and Cancellation Policy;
  5. Applicable Classplus terms for Classplus-powered functions; and
  6. Applicable laws and regulatory requirements.

 

Course-specific information displayed at the time of purchase will control matters such as course duration, fees, medium and included features. Applicable law will prevail over any inconsistent provision of these Terms.

4. Eligibility and Minor Students

Users must be legally competent to accept these Terms.

 

A Student below 18 years may enrol only with the consent and supervision of a Parent/Guardian and subject to applicable age-related laws or admission requirements.

 

The Parent/Guardian:

 

  • Authorises the Student’s registration, admission and use of services;
  • Accepts these Terms on behalf of the minor;
  • Authorises applicable payments;
  • Is responsible for supervising the minor’s use of online services; and
  • Must ensure that the information provided for admission is correct.

 

We may request proof of age, identity or Parent/Guardian authority.

5. Registration and Admission

Registration or admission may require submission of accurate information and relevant documents.

Admission is confirmed only after required information and verification are completed, applicable fees are received and confirmation is issued by the Institute or through the Platform.

Submission of a form or payment does not create a right to admission where eligibility requirements are not satisfied or fraudulent information has been provided.

A registration fee may apply and will be non-refundable, except where otherwise required by applicable law.

6. Accuracy of Information

Students and Parents/Guardians must provide true, complete and current information.

 

The Institute may suspend admission, account access or services if information is materially false, misleading, incomplete or submitted using another person’s identity.

 

Changes to mobile number, email address or other important details must be reported promptly.

7. Course Information

Before purchasing a Course, the Student or Parent/Guardian must review:

 

  • Course name and syllabus;
  • Course duration and access validity;
  • Online, offline, live or recorded format;
  • Teaching medium;
  • Included classes, tests and study materials;
  • Fee and instalment requirements;
  • Faculty details, where stated;
  • Technical requirements;
  • Refund eligibility, if any; and
  • Any course-specific conditions.

 

No oral statement will change written Course Details unless confirmed through an authorised written communication from the Institute.

8. Course Duration and Access

Each Course will remain accessible only for the duration mentioned in its Course Details, order confirmation, admission record or payment receipt. Different Courses may have different validity periods.

 

Swaraj Coaching Institute does not offer lifetime access. A Student must not assume lifetime access merely because Content remains temporarily visible after completion of a Course.

 

Course access may automatically expire when the stated validity period ends.

9. Account Security and Single-Device Access

A Student account is personal and non-transferable.

 

Course access is permitted on only one registered mobile phone or one registered computer, subject to the technical controls of the Platform.

 

Students must not:

 

  • Share their password, OTP or login details;
  • Allow another person to use their account;
  • Sell, rent or transfer account access;
  • Attempt simultaneous access through multiple devices; or
  • Circumvent device or account restrictions.

 

If a registered device is lost, damaged, replaced or reset, the Student must contact the Institute or Platform support. A device-change request may be approved after reasonable identity and account verification.

10. Limited Educational Licence

After payment and confirmation, the Student receives a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access the purchased Course during its stated validity.

 

The licence is only for the Student’s private, non-commercial educational use. Purchasing a Course does not transfer ownership or copyright in any Content to the Student.

11. Fees and Payments

Payments may be accepted through authorised online or offline modes.

 

Students and Parents/Guardians are responsible for verifying the Course name, Student details, payable amount, instalment schedule and payment recipient before making payment. A receipt or payment confirmation should be retained as proof.

 

The Institute will not be responsible for payments made to an unauthorised person, account, QR code or agent unless that payment method was expressly authorised by the Institute.

 

Offers, discounts and coupon codes will be governed by their displayed validity and conditions. Unless stated otherwise, offers cannot be exchanged for cash or combined.

12. Instalments and Outstanding Fees

Where instalment payment is permitted, each instalment must be paid by its due date.

 

If an instalment remains unpaid:

 

  1. The Student or Parent/Guardian will be notified through a registered communication channel; and
  2. If payment is not completed within five calendar days of the notice, Course or batch access may be suspended.

 

Access may be restored after the outstanding amount is received and verified.

 

A suspension caused by the Student’s payment default will not automatically extend Course validity or create a right to refund.

13. General Refund Rule

Course fees and registration fees are generally non-refundable.

 

A Student will not automatically be entitled to a refund merely because the Student changes their mind, does not attend classes, is unable or unwilling to continue, changes examination plans, does not use available Content, experiences personal scheduling difficulties or does not achieve an expected result.

 

Exceptions may apply only where:

 

  • An eligible Classplus Money Back Guarantee applies;
  • A duplicate or demonstrably incorrect payment is verified;
  • The Institute is unable to provide the purchased Course or a reasonable alternative;
  • The Institute gives written approval in an exceptional case; or
  • A refund is required by applicable law or a competent authority.

14. Classplus Money Back Guarantee

A Classplus Money Back Guarantee applies only when the particular Course was expressly offered and purchased with the “Buy With Money Back Guarantee” facility. It does not apply automatically to every Course merely because the Course is delivered through Classplus.

 

For eligible purchases, the Classplus terms displayed and applicable at the time of purchase will govern the claim.

 

As of the Last Updated date of these Terms, the published Classplus conditions state that:

 

  • A claim must be made within 15 days of the Course purchase date;
  • The Student must have attended at least two videos or live classes; and
  • The Student must satisfy Classplus’s applicable attendance/video-consumption requirement, presently stated as attendance in more than 50% of the total videos/live classes or 100 hours of video consumption, whichever is less.

 

The request must be initiated through the purchased Course by selecting “Contact Us” and continuing through the Classplus WhatsApp Support process.

 

Submission, verification, approval and processing of an eligible Money Back Guarantee claim will be handled through the Classplus process and according to the Classplus terms applicable to the transaction.

 

Swaraj Coaching Institute does not independently promise or process a refund for Courses that were not sold with the Money Back Guarantee facility. Nothing in this section removes any right or obligation that cannot lawfully be excluded.

15. Duplicate, Failed or Reversed Payments

A duplicate payment must be reported with the Student’s registered details, transaction ID and proof of debit. Any verified duplicate amount will be handled through the applicable payment provider or Platform process.

 

For failed or pending payments, Course access may remain inactive until payment is successfully received and verified. A bank debit alone does not prove successful receipt by the Institute; payment-gateway and bank records may be used for verification.

16. Batch or Course Transfer

A Student cannot independently transfer themselves to another batch or Course.

 

A transfer request must be submitted to the Institute, requires prior approval and depends on academic suitability, seat availability and operational feasibility. Transfer is not an automatic right.

 

Where the Institute experiences a genuine academic, technical or operational difficulty in the existing batch, the Student may be transferred to another suitable batch after notification.

 

Approval of a transfer does not automatically restart Course validity, create a refund right or entitle the Student to another transfer unless confirmed in writing.

 

Students suspended or removed for misconduct, account sharing, piracy or another material breach will not be entitled to batch transfer.

17. Course, Faculty and Schedule Changes

The Institute may make reasonable changes to faculty allocation, batch timing, class schedule, lecture order, test schedule, classroom location, online or offline teaching mode and supporting academic arrangements.

 

Students will be notified before the change wherever reasonably practicable. In an urgent or unforeseen situation, notification may be provided promptly after the change.

 

The Institute will make reasonable efforts to ensure that an operational change does not materially reduce the core academic value of the purchased Course.

 

If a material service cannot be provided, the Institute may provide a rescheduled class, recording, substitute faculty, alternative batch or another reasonable remedy.

18. Attendance and Academic Responsibility

The Student is responsible for attending classes regularly, reviewing notices and schedule changes, completing assignments and tests, maintaining required study discipline, seeking clarification within available support channels and preparing independently for the relevant examination.

 

Absence from a class does not create an automatic entitlement to a repeat class, private class, Course extension, transfer or refund. Recordings will be provided only where included in the applicable Course.

19. Tests, Assessments and Results

Students must participate honestly in tests and assessments.

 

Cheating, impersonation, unauthorised assistance, copying questions, manipulating results or sharing protected test content is prohibited.

 

The Institute may cancel or withhold a test result where there is reasonable evidence of misconduct, after giving the Student an opportunity to explain wherever appropriate.

 

Internal test scores are intended for academic evaluation and do not guarantee performance in an external examination.

20. No Guarantee of Selection or Results

Our services provide educational preparation, support and guidance.

 

Enrolment does not guarantee selection in any examination, a particular rank or score, admission to any institution, scholarship, employment, promotion or any particular academic or career outcome.

 

Results depend on several factors, including the Student’s effort, attendance, preparation, aptitude, health and examination conditions.

 

Examination dates, syllabus, eligibility, pattern, counselling and admission rules are determined by the relevant authorities and may change independently.

 

The Institute is not affiliated with or endorsed by any examination authority, university or government body unless expressly stated with supporting information.

21. Intellectual Property Rights

All rights in the Institute’s Content—including lectures, videos, recordings, PDFs, eBooks, notes, tests, questions, solutions, presentations, graphics, logos, branding and teaching materials—belong to the Institute or their respective lawful owners.

 

Except where expressly permitted in writing or allowed by applicable law, no Content may be copied, reproduced, recorded, modified, translated, republished, distributed or commercially exploited.

22. Prohibited Content Use and Piracy

Students must not:

 

  • Screen-record, audio-record, photograph or film a class or lecture;
  • Copy, scan, print or download Content except through an authorised feature;
  • Share Content or login access with another person;
  • Upload Content to Telegram, WhatsApp, YouTube, social media, Google Drive, websites, cloud storage or file-sharing services;
  • Sell, resell, rent, sublicense or commercially distribute Content;
  • Operate a paid group or competing coaching service using our Content;
  • Remove or alter a watermark, logo, Student identifier or copyright notice;
  • Extract Content using bots, scraping tools, browser extensions or other technical methods;
  • Bypass encryption, access controls or Platform security;
  • Create unauthorised derivative course packs or commercial question banks substantially based on protected Content; or
  • Assist another person in any prohibited activity.

23. Action for Account Sharing or Piracy

Where reasonable evidence indicates account sharing, recording, unauthorised distribution, resale or piracy, the Institute may:

 

  • Immediately block or suspend the account;
  • Remove the Student from the batch;
  • Permanently terminate Course access;
  • Refuse a batch transfer;
  • Decline a refund to the extent permitted by law;
  • Preserve relevant records and evidence;
  • Issue a takedown or cease-and-desist notice;
  • Report the matter to the Platform or competent authority; and
  • Initiate appropriate civil or criminal legal action.

 

Where legally permissible, the Institute may seek reasonable compensation for actual or reasonably estimated loss, investigation costs and legal expenses caused by the violation.

 

Any financial penalty or compensation will be reasonable, proportionate, supported by the nature of the breach and subject to applicable law. Nothing in these Terms authorises an arbitrary or unlawful fine.

24. Student Conduct and Discipline

Students must treat teachers, staff, visitors and other students respectfully.

 

Abusive or threatening behaviour, discrimination, bullying, harassment, violence, deliberate disruption, property damage, cheating, impersonation, obscene or unlawful communications, misuse of Student groups and unauthorised sharing of another person’s information are prohibited.

 

Depending on seriousness, action may include a warning, removal from a class, temporary suspension or permanent removal from the batch.

 

A Student permanently removed for serious or repeated misconduct will not be entitled to a fee refund or batch transfer, subject to applicable law.

 

Where reasonably practicable, the Student or Parent/Guardian will be informed of the allegation and allowed to provide an explanation. Immediate action may be taken where necessary for safety, security or preservation of evidence.

25. User-Submitted Content

Students may submit assignments, doubts, answers, comments or feedback.

 

The Student retains ownership of original content submitted by them but grants the Institute a limited right to use it as reasonably necessary for teaching, evaluation, feedback, support and service administration.

 

The Student must not submit material that is unlawful, infringing, defamatory, abusive, obscene or invasive of another person’s privacy. Academic submissions will not automatically be used in advertising.

26. Photographs, Testimonials and Achievements

A Student’s name, photograph, video, testimonial, result, rank or achievement will be used for promotional purposes only with applicable consent.

 

For a minor, Parent/Guardian consent will be obtained where required.

 

Consent for advertising a successful candidate will be obtained after the selection where required by applicable guidelines.

 

Result advertisements will make truthful and reasonably complete disclosures, including the relevant Course or programme taken by the Student, where required.

 

Consent for academic or administrative use will not automatically be treated as consent for advertising.

27. Communications

The Institute may send service-related communications through phone calls, WhatsApp, SMS, email, Telegram, mobile application chat, app notifications and other authorised communication channels.

 

These communications may relate to admission, payments, instalments, classes, tests, results, technical support and important notices.

 

Users must keep their registered contact details current. Promotional communications may be stopped by contacting the Institute, subject to legally required or essential service communications.

28. Classplus and Other Third-Party Services

The Institute uses the Classplus platform for mobile application and educational functionality.

 

Classplus and other third-party providers may independently govern their Platform, payment, security and technical services through their own terms and privacy policies. Students should review applicable third-party terms before using those services.

 

The Institute is responsible for its own educational commitments but is not responsible for an independent third party’s acts, systems or outages beyond the Institute’s reasonable control.

 

Where a third-party failure materially affects an enrolled Student, the Institute will make reasonable efforts to coordinate support or provide an appropriate academic alternative.

Students are responsible for maintaining a compatible device, reliable internet access, electricity, updated software or application versions and sufficient storage and technical capability.The Institute does not guarantee uninterrupted Platform availability. Temporary disruptions may occur because of maintenance, updates, internet failures, cybersecurity incidents or third-party outages.The Institute will make reasonable efforts to restore affected services or provide an alternative where a material disruption is within its reasonable control.

30. Offline Centre Rules

Students attending the physical centre must follow attendance and identification requirements, safety and emergency instructions, use classrooms and facilities responsibly, protect Institute property, avoid bringing prohibited or dangerous items and respect the learning environment.

 

The Institute is not responsible for unattended personal belongings, except where loss is directly caused by the Institute’s proven negligence.

31. Privacy and Personal Information

Personal information will be collected, used, stored and shared according to our Privacy Policy and applicable law.

 

The Privacy Policy forms part of these Terms but governs personal-information matters separately.

 

Requests relating to access, correction, updating or deletion of information may be submitted through the contact details stated in the Privacy Policy.

32. Suspension and Termination

The Institute may suspend or terminate access for non-payment, fraud or false information, account sharing, piracy or unauthorised recording, security violations, serious or repeated misconduct, unlawful activity or another material breach of these Terms.

 

Termination ends the Student’s licence to access and use the Content.

 

Provisions relating to intellectual property, liability, compensation, disputes and accrued obligations will continue after termination.

33. Disclaimer and Limitation of Liability

Services are provided with reasonable academic and professional care.

 

To the maximum extent permitted by law, the Institute will not be liable for indirect or consequential loss arising from the Student’s non-attendance or insufficient preparation, changes made by examination authorities, device/internet/electricity failure, unauthorised sharing of credentials, independent third-party services or events beyond the Institute’s reasonable control.

 

Nothing in these Terms excludes liability for fraud, wilful misconduct, gross negligence or another liability that cannot lawfully be excluded. Nothing in these Terms limits a consumer right that cannot legally be waived.

34. Indemnity and Compensation

A User may be required to compensate the Institute for direct loss, third-party claims or reasonable legal costs caused by the User’s fraud, deliberate piracy, unlawful Content distribution, infringement of intellectual-property rights, damage to Institute property or intentional material breach of these Terms.

 

This provision applies only to the extent permitted by law and does not create liability for matters beyond the User’s responsibility.

35. Force Majeure

The Institute will not be treated as being in breach where services are delayed or affected by circumstances beyond reasonable control, including natural disasters, epidemics, government orders, strikes, civil disturbances, fire or building emergencies, widespread internet or power failure, cyberattacks or Platform outages.

 

The Institute will make reasonable efforts to communicate the disruption and provide rescheduled classes, recordings, an alternative batch or another appropriate remedy where practicable.

A complaint should include the Student’s name, registered mobile number, Course or batch name, payment or order details where relevant, a description of the issue and supporting documents or screenshots.

Where applicable, complaints will ordinarily be acknowledged within 48 hours and the Institute will endeavour to resolve them within one month, subject to the complexity of the matter.

37. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

 

The parties should first attempt to resolve a dispute through the Grievance Officer.

 

Subject to the Student’s or consumer’s right to approach any competent consumer commission, statutory authority or court under applicable law, courts and tribunals having jurisdiction in Indore, Madhya Pradesh will have jurisdiction over disputes arising from these Terms.

38. Changes to These Terms

The Institute may update these Terms because of changes in services, technology, Platform requirements or law.

 

The revised Terms and Last Updated date will be published on the website.

 

Material changes affecting an existing paid Course will be communicated where reasonably required and will not be applied retrospectively to unfairly remove an accrued right.

 

Continued use after an applicable update may constitute acceptance of the revised Terms.

39. Severability

If any provision is held invalid or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.

40. No Waiver

Failure by the Institute to enforce a provision immediately does not waive its right to enforce that provision later. A waiver in one case does not constitute a waiver in another case.

41. Assignment

A Student cannot transfer their account, Course access or rights under these Terms without prior written approval.

 

The Institute may transfer its operational rights and obligations as part of a lawful restructuring, transfer of business or change of service provider, subject to applicable law and appropriate notice.

42. Entire Agreement

These Terms, the Course Details, Privacy Policy, applicable Refund and Cancellation Policy, payment confirmation and incorporated Platform terms constitute the agreement relating to the purchased services.

 

If a Course-specific written term conflicts with a general term, the more specific term will apply to that Course, subject to applicable law.

By registering, enrolling, making payment, accessing a Course or using our services, the User confirms that these Terms have been read, understood and accepted.

 

For a minor Student, acceptance must be provided by the Parent/Guardian.
